Terms of the settlement were not disclosed.

Esmark said the litigation arose out of a commercial dispute relating to steel scrap purchased by Wheeling-Pittsburgh Steel Corp. from Herman Strauss.

Herman Strauss, a family owned scrap business in Wheeling, W.Va., claimed that it had suffered more than $18 million in losses because of Esmark's illegal interference with a long-standing supply contract.

Esmark shares fell 2 cents to $16.57 in aftermarket trading, after falling 26 cents to $16.59 in the regular session.
