Delaware court keeps Sprint case alive

OVERLAND PARK, Kan. - A Delaware Chancery Court has refused to dismiss a lawsuit in Sprint Nextel Corp.'s fight with an affiliate over Sprint's next-generation wireless network.

Sprint announced in May that it was teaming up with Clearwire Corp. to create a national high-speed mobile Internet service. The network would provide wireless download speeds comparable to wired computers.

Affiliate iPCS Inc. has claimed the combination, if allowed to operate in its territories, would violate exclusivity agreements it has with Sprint. It has sued in Illinois to stop the deal.

Sprint filed its own lawsuit against iPCS in Delaware. The chancery court denied an attempt to throw out that suit but did remove two iPCS subsidiaries from the case.
