Jan Marini is one of several defendants in a patent-infringement case in the U.S District Court for the Central District of California. The dismissal is based on San Jose, Calif.-based Jan Marini acknowledging the validity of Allergan's relevant patents covering the use of certain drugs that promote eyelash enhancement.

The company also said it would stop selling products containing the ingredients in question.

Shares of Allergan fell 14 cents to close at $52.16.
