Halle Berry won a custody battle with baby daddy Gabriel Aubry, as a judge ruled the Canadian model's visitation with daughter Nahla must be supervised, RadarOnline reported.

The judge also ruled that Aubry will not be allowed any overnight stays with his three-year-old daughter.

The development comes following Nahla's nanny, who was employed by Halle, alleged that she was physically attacked by Aubury, while she was holding Nahla.

The nanny claimed that the alleged assault occurred after she went to pick Nahla up at school and she wasn't there, so she went to Gabriel's home.

"Gabriel and the nanny got into an argument because no one alerted her that Nahla didn't go to school," RadarOnline quoted a source as saying.

But, Aubry has denied the accusation and an investigation is being carried out.

Meanwhile, Halle has also filed paperwork requesting that she be allowed to move with her daughter away from America to her new fiance Olivier Martinez home country in France.

The Catwoman star is reportedly fearing for her life after a recent threat from a deranged stalker, Robert Hoskins , who was locked up for stalking Madonna.

After serving ten years in prison, Hoskins was released last year and then sent to a psychiatric hospital.

The stalker who managed to escape from the mental facility last week was later found on Friday.
