The attorney for Casey Anthony, who was charged with the murder of her two-year-old daughter, is fighting to stop prosecutors from seeking the death penalty.

The Florida mother who was charged with first degree murder of her daughter, Caylee Anthony, cried in court Friday as the prosecutor speculated how the toddler was killed.

Anthony misled investigators about what happened, she also hid the little girl's remains and lied to detectives about a baby sitter kidnapping her.

The trial has been postponed to January 2010. Anthony has pleaded not guilty to the charges.
