Chris Soules’ attorneys are asking the court to dismiss the charges filed against the “Bachelor” alum for allegedly leaving the scene of a fatal car accident.

In the court documents obtained by People, it was revealed that the 35-year-old reality TV star violated one of Iowa’s codes regarding accidents. “If the accident causes the death of a person, all surviving drivers shall remain at the scene of the accident except to seek necessary aid and to report the accident to law enforcement authorities,” it stated.

Soules was accused to leaving the scene following a deadly car crash in Iowa on April 25. The incident left 66-year-old war veteran Kenneth Mosher dead.

But the ABC star’s attorneys claimed during a recent filing that Soules stayed by Mosher’s side. “Mr. Soules checked on Mr. Mosher to determine if he was conscious and breathing. Mr. Soules then administered CPR to Mr. Mosher, reporting to dispatch that Mr. Mosher had blood coming out of his mouth,” the document read.

However, the Iowa State Patrol claimed that the “Dancing With the Stars” alum fled the scene, and his vehicle was found park at his home where he was at. Soules also allegedly refused to leave his property until officers obtained a search warrant several hours later.

Soules was not charged with DUI, but court documents also detailed that alcoholic beverages and containers were found in his car. In June, his attorneys revealed that Soules’ specimens tested negative for drugs and alcohol.

In this week’s filing, Soules’ attorneys asked the court to drop the charges against their client and said that he fully cooperated during the investigation. However, the Iowa State Patrol previously claimed that Soules refused to cooperate with them during the investigation.

Six months ago, Soules also appeared in court where he pleaded not guilty to the “leaving the scene” charges. He stated that he called 911 and administered first aid on Mosher and even identified himself.

Soules is slated to appear in court for trial in January.
