Hulk Hogan has refiled the $100 million lawsuit over his sex tape with the wife of his former best friend, suing both Gawker and Heather Clem for allegedly releasing the video.

According to TMZ, 59-year-old Hulk Hogan dismissed the suit in federal court in December without prejudice but recently refiled the case in Florida state court.

Hogan is now suing both Gawker for leaking the video as well as Heather Clem, who was seen in the sex tape with him, for playing a role in leaking the video to the media.

Hogan’s lawyer told TMZ he initially dismissed the federal case in order to consolidate the two suits.

The sex tape made its rounds on the Internet in October after Gawker posted a portion of the 30-minute long video, showing Hulk Hogan, whose real name is Terry Bollea, engaging in sexual conduct with Heather Clem. According to Gawker, Clem was married to Hogan’s best friend, famous radio DJ Bubba the Love Sponge.

Hulk Hogan filed suits on Oct. 16 against Gawker for posting clips of the video, filmed six years prior to its release. He also sued Bubba the Love Sponge for unspecified damages, claiming he released the video. However, the lawsuit was settled and Sponge issued an apology.

"Terry Bollea is appalled at the unauthorized release of a secretly filmed video,” his lawyer David Houston told TMZ. "[Hulk] neither approved of the filming nor the release of the same. It is clearly an outrageous invasion of privacy and breach of trust if it is genuine. We will take all necessary steps to enforce both civil and criminal liability.”

According to Gawker, the video was first mentioned to gossip sites back in April but an unnamed source gave Gawker the tape.

“They wanted no payment. They wanted no credit. Their only request was that we watch it,” Gawker said.

Hogan has been married to wife Jennifer McDaniel since 2010 after splitting from ex-wife, Linda Hogan, in 2009 after rumors he cheated.
