A Minnesota mother, Joan Najbar, is suing the federal government after a letter she sent to her son in Iraq was returned deceased stamped on it despite her son being alive.

Najbar of Duluth claims in her lawsuit against the federal government and the U.S. Postal Service that she suffered emotional distress and loss of income and is seeking damages as a result of the incident.

The lawsuit was filed last month.

Najbar's son Sam Eininger was serving with the National Guard in Iraq in 2006 when the letter was returned. The letter was mailed in September 2006 and then returned two weeks later.
