The Complaint charges that KV and certain of its officers and directorsviolated federal securities laws. Specifically, defendants failed todisclose: (i) that KV's facilities were in disarray resulting in themanufacture of unsafe drug products that would have to be recalled due tothe fact that they may contain oversized tablets with more than theintended levels of the active drug ingredient; (ii) that KV failed torecall unsafe drug products; (iii) that KV's manufacturing facilitiesfailed to comply with FDA requirements; (iv) that manufacturing disruptionswere resulting in a material backlog of unshipped customer orders; (v) thatKV failed to write off at least $24 million in discontinued products,seized by the U.S. Attorney for the Eastern District of Missouri; and (vi)that KV's post-January 2008 sales of generics declined following theexpiration of KV's exclusive sales period for the drug metoprololsuccinate.

A leadplaintiff is a class member that acts on behalf of other class members indirecting the litigation.
