Apple To Appeal Samsung Sale Ban Decision Next Month

Samsung Electronics Co, Ltd. (LON:BC94) and Apple Inc. (Nasdaq:AAPL) will duke it out again over patent infringement early next month when the two technology giants go before an appeals court.

The U.S. Court of Appeals for the Federal Circuit in Washington, D.C., said it will hear 15 minutes of oral arguments from both companies' attorneys on Aug. 9, nearly a year after the U.S. District Court for the Northern District of California in San Jose found that Samsung copied some of Apple's iPhone design in 26 of its phones and tablets, ComputerWorld reported.

Apple was awarded more than $1 billion in damages. But Judge Lucy Koh decided not to issue an injunction for the products that were considered to be intringing.

"To the limited extent that Apple has been able to show that any of its harms were caused by Samsung's illegal conduct (in this case, only trade dress dilution), Apple has not established that the equities support an injunction," she wrote in her ruling in December.

Apple appealed the decision, and that case will be heard in August.
