Shaniya was last seen alive in the arms of Mario Andrette McNeill, 29, in hotel surveillance footage where he was carrying Davis into an elevator.
McNeill turned himself into Fayetteville police Friday where police charged him on kidnapping charges, cbsnews reported.
Since then Shaniya was found dead alongside a North Carolina highway near her Fayetteville hometown in North Carolina.
McNeil's charges are likely to become murder charges.
The five-year-old's mother, Antoinette Davis, faces human trafficking and child prostitution charges
