Halle Berry's stalker will see his day in court after a judge has held up the charges against him.

The alleged stalker, Richard Franco, has pleaded not guilty to charges of burglary and stalking, The Associated Press reported.

Franco was caught red-handed by police in July after the Oscar-winning beauty saw him on her property and called authorities.

He had trespassed three times in three days, The AP reported.

He is being held on $150,000 bail and is expected to be arraigned on Oct. 31, The AP reported.

This person has invaded and trampled upon the most fundamental sense of security I have, and I am extremely frightened of him and what he might do to me or those I love, Berry wrote in a petition to get a restraining order against Franco, The AP reported.
