Of all the people to find it shocking that a Hulk Hogan sex tape may be finding its way to skeezy hard drives everywhere, perhaps the most surprised was Hogan himself. When news of the racy tape hit the web yesterday, the 58-year-old professional wrestler/semi-pro actor reportedly became enraged, bewildered and ready to seek the maximum criminal penalty for whoever may release the tape. Hogan's attorney David Houston made the divide between civil and criminal charges on the topic, also pointing out states where two-party surveilance laws are still practiced--making the unauthorized release of the tape a felony.

It sounds like somebody who hit hard times and had the tape and hooked up with someone who had the ability to market it, Houston told TMZ last night. And in fairness to them we want to put them on notice. They're comitting a felony. And a lot of people may not be worried about civil liability because they may not haver anything. But I think everybody's worried about whether or not they're going to spend time in jail. If anyone goes forward with this thing, we're going to find them and we're going to prosecute them.

Houston told E! News previously that Hulk was appalled at the unauthorized release of a secretly filmed video.

TMZ reports the woman in the video is neither Hogan's ex-wife nor his current wife, based on Hogan's proclivity for blondes and the voyeur's brunette hair. Hogan told the celebrity news site that during a period between meeting his ex-wife Linda Hogan--who Hulk sued for defamation over claims of abuse and homosexuality in Dec. 2011--and his current wife Jennifer McDaniel.

I had about four and a half months where I went crazy, Hogan told TMZ about his daliences after divorce. I was really out of my mind for awhile.

Though he can't remember who the woman may be, Hogan does know that he's been married to McDaniel for five years. Hogan told TMZ just how dumbfounded he was over why someone would wait so long to unveil the footage. He also was confused just as to how the footage was made. Where was the camera?

I'm dumb but I'm not dumb and dumber, Hogan said.
