Jameis Winston was on top of the world earlier this week. He led Florida State to a win in the BCS National Championship Game, just a few weeks after he was the runaway winner of the Heisman Trophy. Now, the football star is back to facing legal issues.

Winston is soon to face a civil lawsuit from the same woman who accused him of rape. Attorney Patricia Carroll, who’s representing the accuser, says Winston and the Tallahassee Police Department will be targets of the suit.

"I want heads to roll," Patricia Carroll told ABC News."The family is proceeding, with civil action against the TPD and Jameis Winston and possibly the university."

In early December, the Florida state attorney decided not to charge Winston with sexual assault. The woman, an FSU student, claimed she was raped by Winston at an off-campus apartment on Dec. 7, 2012. Winston claims the encounter was consensual.

"We have a duty as prosecutors to determine if each case has a reasonable likelihood of conviction," state attorney Willie Meggs said at the time. "After reviewing the facts in this case, we do not feel that we can reach those burdens."

The 19-year-old woman withdrew from classes when the media reported on the allegations in November. Her lawyer claims that police department mishandled the investigation, causing the state attorney to not file charges.

"Absolutely you're going to see a civil suit," Carroll told ABC News. "You cannot have law enforcement that is not held accountable."

The police department has defended itself against Carroll’s allegations. In a statement, spokesman David Northway said no wrongdoing was found by law enforcement, and there will not be an internal investigation on the matter

“The reports in this case document that our department took the case seriously, processed evidence and conducted an investigation based on information available at that time,” Northway continued. “We take seriously the obligation to respond to any individual who wants to report a crime."
