Wesley Snipes’ lawyers have filed a new appeal against the Blade actor’s three year jail term for tax evasion.

His lawyers have filed the appeal in a Florida court on the hopes of carrying the case up to the Supreme Court. They are requesting the court to free the Snipes on bail so that he can fight the case.

The lawyers want the Supreme Court to decide on a new trial based on allegations of mistrial in the earlier case , reports TMZ.com.

An unnamed jury member of the 2008 trial has made claims in an email to Snipes’ lawyers that the jury members had decided on the verdict before the trial had begun, reveals the website.

The actor has been fighting his 2008 conviction for tax evasion for the past two years but lost an appeal recently . He is at present serving a three year jail term from December 9 in a minimum security prison in Pennsylvania.
