  • Some social media users accused her of being "tone-deaf" for posting sultry photos amid her legal woes
  • Jayne and her ex Tom Girardi are being sued for allegedly stealing funds meant for the families of victims killed in a 2018 plane crash

Erika Jayne raised eyebrows with her recent posts on social media.

On Wednesday, the "Real Housewives of Beverly Hills" star, 50, took to Instagram to share a black and white photo in which she posed in nothing but jeweled underwear, a pair of heels and bracelets. Jayne didn't write anything in the caption, only posting two sparkle emojis.

Social media users immediately flooded the comments section of the post with criticism over the display, which comes as Jayne and her estranged husband Tom Girardi are being sued for allegedly embezzling money owed to the families of the victims of a 2018 plane crash.

"STOP IT ERICA [sic]. YOU SERIOUSLY HAVE NO EMPATHY. COME ON... Time and a place to share your naked body. During a pandemic and your upcoming trial really not helping yourself at all," one Instagram user commented.

Wrote another, "[This] post will not help your court case. Pure arrogance."

"This is what you will be left with—nothing," a third user wrote. "Are you advertising for your next get-rich-quick scam?" another commented, adding, "Pay the victims!"

"No shame. No humble [sic]. No money to the victims," a fifth user wrote, adding "Tone deaf."

However, fans and friends of Jayne praised the photo. Clyde Haygood wrote "Fav," while "RuPaul's Drag Race" star Bianca del Rio left several raising hands and heart emojis.

"Real Housewives of Dallas" star Tiffany Moon teased Jayne, writing, “You need some clothes boo?" Erin Alysha Barnett commented, "Killing in gorgeous."

Some encouraged Jayne to "ignore the hate," while one fan wrote, "Erika, be strong and you will get through it."

Jayne also received backlash over an Instagram post when she shared a nude photo with the caption, "Another Friday night," over the weekend.

Kenya Moore praised the singer, writing, "That arch sis." However, others were not as thrilled, with one user asking Jayne to "read the room" amid her legal drama.

Jayne's legal woes began after she filed for divorce from Girardi in November 2020. The exes were sued the following month by a class-action law firm on behalf of victims of Lion Air Flight 610 for allegedly embezzling money through their "sham" divorce. Girardi's law firm, Girardi Keese, was forced into Chapter 7 bankruptcy shortly after.

Last month, Jayne was sued by the trustee handling the bankruptcy case of her estranged husband's law firm. While the reality star has denied having knowledge of the legal issues that Girardi, 82, was facing, she was accused in the lawsuit of knowing that her ex's firm had been paying for her expenses for at least 12 years. Jayne allegedly spent over $25 million of the firm's money on glam squads, PR companies and her Amex bill.

The trustee wants Jayne to pay back the $25 million she allegedly spent plus interest.

In response, Jayne's lawyer accused the trustee of "bullying and blaming Erika for actions taken by Girardi Keese for which Erika does not have legal liability."
