Women Walk In On Male Babysitter Sexually Assaulting 3-Year-Old

A Texas man was arrested Wednesday after two women, for whom he was babysitting, walked in on him sexually assaulting a 3-year-old girl, police said.

The suspect, James Delavega, was watching three children Tuesday evening in the 200 block of Pagoda Drive in the Dallas suburb of Anna.

The mother of the children and another woman were out Tuesday night when the incident took place, the police said. A report on CBS DFW said Delavega was the second woman’s father.

Police Chief Jeff Caponera said when the women returned, they found Delavega performing a sex act on one of the children, following which they contacted the police and reported the incident.

Officers were dispatched to the scene, who upon arrival, contacted investigators and confirmed there was “enough probable cause to believe he committed the act we were being told about.”

“While you were sleeping… James Delavega, a 40-year-old resident of Plano, was arrested for committing sexual acts on a three-year-old child he was babysitting in Anna. Another child sexual predator taken off our streets by the efforts of your @AnnaTXpolice department,” the department tweeted Wednesday. They later corrected their statement and said the man was 50-years-old.

Caponera declined to comment any further or reveal any details regarding the incident. He did not specify the specific sex act Delavega performed on the child, but said it was “quite honestly, disgusting.”

The police chief said they were yet to receive results from Sexual Assault Nurse Examiner when CBS DFW asked if there was any physical evidence to support the accusation. He added he did “believe there will be substantial evidence to confirm our suspicion.”

Delavega was facing an enhanced charge of aggravated sexual assault of a child, and his bail was not immediately set. According to reports, he was currently detained in the Collin County jail, and the case was being investigated by detectives from the Collin County Child Advocacy Center and the Anna Police Department along with the Plano Police Department since Delavega lived in Plano.

The suspect’s son told CBS11 he was just learning about the incident, but their family members were shaken and surprised when they came to know of it.

If convicted, he could face 25 years to life for the crime due to a 2007 Texas law, which increased the minimum penalties in sexual assault cases that involved victims who were minors. Delavega had no previous criminal record in the Dallas-Fort Worth area.

In an unrelated incident, an Osceola County man was arrested Sept. 17 on charges of lewd and lascivious molestation of a child under 12 years of age, after a Chestnut Elementary School student told a school resource officer she was being molested by Shaun Wesley Flowers, 32, for the past one month.

He left jail Sept. 20, while denying the charges.

"I didn't do it, and I'm just going to say no comment after this," Flowers told Channel 9 while leaving jail. "I don't know where you're getting this information from ... I have nothing else to say.”

Detectives were still looking into the case to determine if Flowers has any other victims.
