Jenna Talackova, the 23-year-old beauty queen from Vancouver who was thrown out of Miss Universe Canada Pageant for not being a naturally born female, has determined to fight for justice.

Talackova tweeted: I'm disqualified, however I'm not giving up. I'm not going to just let them disqualify me over discrimination.

The young transgender, who got media attention from around the world, will be taking the Donald Trump-owned beauty pageant to court. Thousands of people have come forward to support her cause, and now she has legal representation for her battle against the pageant's decision.

Miss Talackova has now retained legal counsel in both Canada and the United States, stated a release Friday, according to the Vancouver Sun.

A petition created by a man from Brooklyn, NY, and hosted on www.change.org, already has more than 40,000 signatures supporting Jenna Talackova.

The Petition reads: Ms. Talackova has been disqualified from the Miss Universe Canada contest solely for being transgender. This is discriminatory, unjust, and quite frankly disgusting. She is a woman and deserves to be treated as any other woman would be. What kind of genitals she was or was not born with (and even what kind of genitals she has today) is completely irrelevant. This petition is to get her reinstated as a contestant, since she was unfairly disqualified.

The petition talks about the rules and regulations written for beauty pageants which nowhere state anything about a sex-change surgery. The rules say, Miss Universe Canada contestants must meet a basic requirement of being a Canadian citizen and between the ages of 18 and 27 to compete. They also must not be married, pregnant, and have to fill out a more comprehensive form if they meet the basic requirements. There is no mention of rules regarding sex-changes or cosmetic surgery.

Talackova, who is overwhelmed by the support bestowed upon her by people all over the world, understandably realizes that her case could be a significant landmark for the dignity and liberty of LGBTQ citizens everywhere, said the release.

The beauty pageant dumped the transsexual contestant stating that she did not meet the requirements to compete despite having stated otherwise on her entry form.

Apparently, according to pageant rules, every contestant must be a naturally born female only.

Jenna Talackova from Vancouver, British Columbia will not compete in the 2012 Miss Universe Canada competition, organizers officially confirmed in a statement issued on Friday.

We do, however, respect her goals, determination and wish her the best, the statement included.

Talackova will be holding a press conference Tuesday.
