  • Jayne alleged that her estranged husband had an affair with a California judge

Erika Jayne didn't expect Tom Girardi would cheat on her and couldn't believe the lawsuits they are facing amid their messy split.

Jayne, 49, was reportedly "very up and down." She was in disbelief at how her over two decades of marriage with Girardi, 81, ended. "The Real Housewives of Beverly Hills" accused her husband of infidelity.

"She’s still in disbelief that Tom would cheat. She’s also in disbelief with all these lawsuits that are coming that no one was aware of," an insider told Us Weekly. "The legal issues are unfolding one after another and she’s learning as everyone’s filing. As the whole world is finding out about it, she’s finding out about it. She’s reading about it in the press before she even sees it [from her lawyers]."

The Bravo star filed for divorce in November and alleged that the lawyer had an affair with a California judge. On Dec. 18, Jayne posted and deleted several text messages and photos from a woman named Tricia A. Bigelow whom she alleged was her husband's mistress.

"This is Justice Tricia A. Bigelow. She was f–king my husband Tom Girardi and he was paying her Saks bill and paying for her plastic surgery," she wrote.

Meanwhile, the judge's lawyer released a statement on Dec. 22 addressing Jayne's deleted post. The lawyer said Erika's "actions in maliciously doxxing the Justice were nothing short of criminal."

"We are considering our options to protect Justice Bigelow from further harassment," Bigelow's lawyer concluded.

Girardi has not made a public statement to address the cheating allegation. The high-profile attorney is under fire for allegedly embezzling money. Earlier this month, he announced that he was already broke and didn't have enough money as his creditors believed.

"At one point I had about 80 million or 50 million in cash. That’s all gone. I don’t have any money," he said.

He also refused to pay Jayne spousal support. Instead, Girardi asked that she pay for his attorney fees.
