The attorney for James Whitey Bulger, the reputed Boston gangster who went on the lam for 16 years and was captured in California last year, wants to delay Bulger's upcoming trial for a year, enraging prosecutors.

J.W. Carney, the attorney for James Whitey Bulger, is asking for the trial to be put off because he claims the mountain of evidence would take him a year to go over the 300,000 documents, 30 videos and 1,000 cassette tapes, United Press International reported.

Bulger, the 82-year-old reputed former head of Boston's Winter Hill Gang, is scheduled to stand trial Nov. 15. He is accused of being involved in 19 murders.

To maintain that date will eviscerate the defendant's rights to due process of the law and to effective assistance of counsel under the Fifth and Sixth Amendments to the federal Constitution, Carney said, according to UPI.

Carney's attempt to get Whitey Bulger's trial delay was slammed by prosecutors.

The families of nineteen murder victims as well as numerous other extortion victims have waited for almost seventeen years for justice because the defendant decided to remain a fugitive for sixteen years, prosecutors wrote in court papers, the Boston Herald reported. Some of these victims have passed away while the defendant walked the beaches of Santa Monica. If delay is defense counsel's goal, his current strategy is understandable. However, the Court should not allow such a strategy to control the timing of the defendant's trial.

The families of Bulger's alleged victims told Fox News they're pessimistic Whitey will face justice.

I don't think in my heart that we're ever going to close this case. I don't think he's going to last that long or live through it, said Steve Davis, whose sister, Debra Davis, was allegedly strangled by Bulger in 1981.

Bulger was captured in Santa Monica, Calif., in June 2011 following an FBI blitz of a public service announcement campaign that targeted 10 states where the feds believed Whitey may have been hiding. California was one of those states.

Whitey Bulger eluded authorities due to help from girlfriend Catherine Grieg, who was sentenced to eight years in federal prison earlier this month for her role in harboring the fugitive and reputed Boston mobster in Santa Monica.

A lawyer for Grieg said she had no regrets because she was in love with the guy and lived with him for 16 years.
