A man was shot to death at a Waffle House in Georgia on Halloween after reportedly hurling racial slurs at other customers and starting a fight.

The incident occurred late Thursday when local police received several calls from a Waffle House in Butts County, Georgia. The first call was about a problematic customer, the second was for a fight that broke out, and the third was for shots fired. By the time police arrived, the fight had subsided and the man who allegedly started the disturbance had been shot.

Nicholas Phinazee Bryan, 27, had allegedly been hurling racial slurs at two other customers identified as Robert Lewis Henderson, 36, and Antonio DeMarty Evans, 39. Staff at the Waffle House reportedly told Bryan to leave before the situation escalated. However, Bryan allegedly continued until he got into the reported fight with Evans, which ended with Bryan being shot.

According to the Butts County Sheriff's Office, Henderson had pulled out a gun and shot Bryan.

Bryan was rushed to nearby Monroe County Hospital in nearby Forsyth to undergo treatment but was later declared dead around 3 a.m. His body was sent to the Georgia Bureau of Investigation crime lab to undergo an autopsy.

Local police and GBI are currently investigating Bryan’s death. Henderson and Evans have not been charged as of Tuesday morning.
