"Shark Tank" judge Kevin O'Leary and his wife, Linda, are being sued for wrongful death just a few months after their involvement in a boat crash this summer.

The fatal incident happened on Aug. 24 in Ontario, Canada and resulted in the deaths of Gary Poltash, 64, and Susanne Brito, 48. Linda was charged with "careless operation of a vehicle" by Ontario Provincial Police in September, but now Brito's family is seeking justice from the mogul's family, as well as others who were involved in the crash.

"For this grieving family, it is about obtaining civil justice so as to prevent these types of deaths and curtailing reckless and dangerous behaviour from continuing on our lakes," Patrick Brown, of law firm McLeish Orlando LLP, said in a news release, according to the Toronto Sun.

Linda’s case is next set to be heard on Nov. 21.

It's likely that the O'Leary family won't be commenting on the new lawsuit out of respect for the victims' families, as they did while initially being investigated by the OPP.

"Out of respect for the victims' families and to fully support the ongoing investigation I feel it is inappropriate to make further comments at this time,” Kevin said in a statement at the time. “My heartfelt prayers and condolences to the victims, the families and those affected by this loss.”
