Fans will get to watch as he marries longtime girlfriend Lauren Pesce and hangs out once again for a good time with his “Jersey Shore” family. However, Mike “The Situation” Sorrentino won’t be joining any of his pals for a watch party as the new season of “Jersey Shore: Family Vacation” airs.

Sorrentino, 37, is currently serving time in prison after entering a guilty plea for tax evasion in 2018. The plea came after he and his brother Marc were initially indicted in 2014 for tax fraud after they failed to pay taxes on the reality star’s $8.9 million income from 2010-2012. They were both later indicted in 2017 on additional charges of falsifying documents and tax evasion. Following his plea, The Situation was sentenced to an eight-month prison sentence, which he started serving on Jan. 15, 2019 at the Otisville Federal Correctional Institution in Otisville, N.Y.

Sorrentino’s official release date is slated for September 13, 2019, however, he could get an early release. In an interview with Radar Online, Federal Prison Consultant and Expert Dan Wise revealed that the short sentence would likely see him taken from the prison early in favor of some other confinement.

“On such a short sentence of 8 months they will send him to a halfway house for two to three months at the end,” Wise said. “Because of who he is, he may even get home confinement.”

His brother, meanwhile, was sentenced to two years in prison, which he is serving at the Federal Correctional Institution in Fairton, N.J. It was reported in January that an inmate at that facility who was serving a 77-month sentence for entering the U.S. illegally from Mexico had been killed there in February 2018.

While his co-stars are having to watch their new season of the show without him, they revealed to Entertainment Tonight that he’s been doing well behind bars and still has a positive attitude.

“He’s doing better than me. He literally, like, eats well, he goes to the gym twice a day. He gets a haircut twice a week,” Vinny Guadagnino shared. “He looks refreshed. And his mindset never changes. Like, we email him and I always think that one day he’s going to be like, ‘Not having a good day.’ He’s always making me laugh, he’s like, ‘Yo, I saw you on TMZ,’ because they watch TV and stuff. He’s still our biggest supporter.”

“Jersey Shore: Family Vacation” returns tonight at 8 p.m. EDT on MTV.
