Joe Giudice was released from prison on Thursday after serving a 41-month sentence for tax fraud, but he is not a free man just yet. The Bravo reality star is currently in the custody of the U.S. Immigration and Customs Enforcement, and can possibly be deported to Italy, where he was born.

“Mr. Giudice has finished serving his federal prison sentence and was transferred early this morning from the Bureau of Prisons to a facility in western Pennsylvania which houses immigration detainees,” Giudice's lawyer, James J. Leonard Jr., said in a statement to USA Today.

“His lawyers and his family are hopeful that justice will prevail, and Mr. Guidice will return home to his wife and four daughters who love him and miss him.”

The 46-year-old’s wife, Teresa Giudice, who stars on “The Real Housewives of New Jersey,” also served time in prison for tax fraud in 2015 and was given a 15-month sentence. Over President’s Day weekend, she was spotted getting close to 26-year-old Blake Schreck in Miami. Giudice has previously confirmed that she will leave her husband if he is deported.

"I hope that's not a decision I have to make, but just to pick up my children and just move to another country, I don't think that would be good for my children," she told Bravo host Andy Cohen in March. The mother-of-four added that their kids, born in the U.S., could suffer a language barrier when they move to Italy because they don’t speak Italian.

“It’s like starting a whole new life and they’ve been through so much already,” she said.
