Do you live in the U.S. and did you purchase a pair of Powerbeats 2 wireless earbuds before Aug. 7? You might be eligible for a payout from Beats parent company, Apple.

Apple has agreed to a settlement in a lawsuit first leveled against them in 2016 over the product, which itself was released in 2014. Per the settlement, the tech giant will payout $9.75 million to U.S. residents who bought the earbuds, though it still insists that it did nothing wrong, naturally.

The lawsuit accused the company of false advertising while selling the Powerbeats 2. In the marketing materials, the company touted the products as “sweat & water resistant” – a common selling point for products used extensively at the gym – and “built to endure.” But customers found the earbuds were of “shoddy” quality and would also stop charging fully after a short time.

The lawsuit also mentioned issues found in the Powerbeats 3 from 2016, but Apple’s settlement only pertains to the earlier model. While not believing itself to be at fault, Apple reportedly found it cheaper to pay a settlement rather than go to trial.

So, how do you get in on this settlement if you bought a pair of these sub-standard earbuds? Just go to the lawsuit’s official site and file a claim before Nov. 20. The amount paid out will depend on the number of people that apply and are deemed eligible, but the maximum hypothetical payout is said to be $189.
