Joe Giudice has spent the past month in ICE custody and it's been revealed that his deportation appeal has been denied.

The husband of "Real Housewives of New Jersey" star Teresa Giudice served a 41-month sentence for tax fraud, and now it appears he will soon be deported to his native Italy, though he has lived in the United States since he was a baby.

"The Board of Immigration Appeals dismissed the case on April 11, 2019," the Executive Office for Immigration Review said.

Entertainment outlet E! first reported that Joe Guidice’s legal team filed a petition for the federal court to review the decision.

"We are extremely disappointed that the Board Of Immigration Appeals has denied Mr. Giudice’s appeal. We have filed a stay with the Third Circuit Court Of Appeals and will continue to fight to keep Mr. Giudice in the United States, the only country he knows, and reunite him with his wife and four daughters," Joe Giudice's attorney James J. Leonard Jr. said in a statement.

The couple has daughters Gia, 18, Gabriella,15, Milania, 13, and Audriana, 10.

Joe Giudice has spent the last month in the Clinton County Correctional Facility in McElhattan, Pennsylvania.

Teresa Giudice reportedly is prepared to divorce if he is deported, and previously told Bravo host Andy Cohen that "unless my kids say, 'Mommy, we want to move to Italy,' [we] are not going].

"Gia’s going to college next year; I haven’t spoken to Milania or Audriana about it, we haven’t gotten there yet; and Gabriella already voiced her opinion to me. She was like, 'That would be so hard for me, Mommy.' She doesn’t speak the language. She’s like, ‘That would kill me even more,'"Teresa Giudice.
