Several months have come and gone since Bobbi Kristina Brown’s passing, but for Bobby Brown and the rest of her family, the wound is still fresh. Nick Gordon, the aspiring actresses former boyfriend, is currently facing legal action for allegedly contributing to her untimely death. Her father, Bobby Brown, 46, released a statement Monday in which he shared new details about their case against Gordon.

In a statement issued to Us Weekly Bobby Brown’s lawyer, Christopher Brown, shares that the family blames Nick Gordon, 25, for Bobbi Kristina Brown’s death. The statement went on to reveal that Gordon filed a motion to have the lawsuit being filed against him thrown out, but was unsuccessful. The suit was reportedly seeking $40 million in damages from Bobbi Kristina Brown’s former boyfriend. He has since decided to withdraw his motion in the hopes that it would end the issue, allowing him to avoid giving a deposition. According to Us, he will now have to read his deposition after swearing an oath.

“In regards to the civil litigation, we believe we know who harmed Bobbi Kristina Brown and his name is Nick Gordon,” Brown told Us. “Mr. Gordon made headlines when he filed his Motion to Dismiss the lawsuit pending in Superior Court that seeks to hold him responsible for 40 Million Dollars in damages. However the Motion was frivolous and instead of having it heard by the Court, he has chosen to withdraw the Motion, ending that matter so that he could avoid having to give his deposition which was scheduled for the day he withdrew the Motion. Mr. Gordon will now have to give his deposition under oath.”

Bobby Brown isn’t the only member of Bobbi Kristina Brown’s family who blames Gordon for her death. As was reported on Sept. 16, her aunt, Leolah Brown, told Inside Edition her niece’s death was “no accident.” She added that she also believes someone killed Bobbi Kristina Brown’s mother, Whitney Houston. The Grammy award-winning artist died in 2012 in a similar incident to that of her daughter. Still, Gordon’s lawyers claim all allegations against him are “without merit” and maintain that he is innocent.

It was initially reported that Bobbi Kristina Brown’s family planned to face-off with Gordon in court in August. Her conservator, Balbina C. Hargrove, filed a lawsuit against Gordon claiming he returned to the townhouse he and Bobbi Kristina Brown shared at around 6 a.m. on Jan. 31. He had allegedly spent the night “on a cocaine and drinking binge” and found himself in the middle of a heated argument with Bobbi Kristina Brown upon arriving at the home. The documents claim he allegedly slipped her a “toxic cocktail” that caused her to lose consciousness before putting her in the bathtub facedown. Another female is said to have been in the home at the time of the incident.

Bobbi Kristina Brown died on July 26. She was 22.
