A New York man was killed in a police officer-involved shooting after the Niagara town cop responded to a call to resolve a mother-son argument at their house Saturday night.

The incident happened at 8:45 p.m. at the house that was also shared by the deceased man's son.

"As result of an officer involved shooting, a 40-year-old male is deceased. No one else at the scene was injured," the department said in a release Sunday morning, WKBW reported.

The victim of the officer-involved shooting has been identified as 40-year-old Daniel D. Kachinoski, who lived on Chester Avenue.

His brother Nicholas Campbell is now seeking answers as to how a mother's call for help left a 7-year-old fatherless, Buffalo News reported.

"He keeps asking if his daddy is in heaven," Campbell said Sunday, adding the boy was asking for his father's picture.

The mother-son duo reportedly engaged in an argument after Kachinoski's mom returned from work after working a long nursing shift at the hospital.

Family members said the call to the police was made to dissipate the situation. Kachinoski's cousin, Kyle Humphrey, and Campbell said matters got worse after the police arrived. They ended up using a taser on Kachinoski in the presence of his mom and son, who he was raising as a single parent. The two went inside a bedroom upon hearing gunshots.

Campbell reportedly believes his brother was shot twice in the chest, and that a knife was present at the scene.

The victim's family has also raised questions regarding the police's handling of the matter.

"I believe his mom was calling for help, not for them to kill her son," Humphrey said. "Where's the training?"

Police chief Craig Giuliani said he will update the press regarding the incident Monday. He had declined earlier requests for details about the circumstances involved in Kachinoski's death. There is body camera footage of the incident, Giuliani told Buffalo News.

They are putting together the footage, and it will be released so that people can understand the situation and why Kachinoski was shot by the officer.

"We will release an excerpt of it," he said. Video footage from the home, and the deceased's phone has been taken by police as evidence, he said.

The Town of Niagara Police Department along with the Niagara County Sheriff's Office, the Niagara County District Attorney's Office, and the State Attorney General's Office are investigating the case.
