A couple in Florida has been arrested after a man was seen engaging in a sex act on a public beach in Clearwater in front of families and children after they were believed to have been under strong alcohol influence, reports said Tuesday.

Jeffrey Kernan, 50, of Tampa "was performing oral sex on his girlfriend... in front of families and children," on the Clearwater beach at around 5 p.m. EDT Sunday afternoon, according to the arrest affidavit, which was first obtained by the Smoking Gun.

Both Kernan and his girlfriend Alexandria Rowell, 26, of Winter Haven were said to be drunk, according to the document.

Kernan and Rowell were both booked into the county jail Sunday evening on misdemeanor charges. However, Kernan posted his $250 bond Monday afternoon and was released soon after. Rowell still remained in police custody.

According to JD Journal that provides legal news to attorneys, lawyers and paralegals, the couple was apparently contacted by a police officer while they were involved in the act; however, they were not charged with public indecency. Instead, they were both arrested separately for possession of an open container of alcohol—a 16-ounce can of Four Loko, according to Fox News.

The arrest affidavits indicated that there was an "indication of alcohol influence" with regard to both the defendants.

Four Loko is a line of alcoholic beverages sold by Phusion Projects of Chicago in four standard drinks. The drinks have been the object of legal, ethical, and health concerns as the company allegedly marketed the product to underage drinkers. The company also combined alcohol and caffeine in their drinks.

An infamous incident in 2010 led to the ban of the drink in Washington as a group of Central Washington University students became ill after consuming the product. The product was reintroduced in December 2010 when the company sold them without caffeine, guarana, and taurine as ingredients and they are no longer marketed as energy drinks.

In August this year, a couple at the Wisconsin State Fair was caught having sex by visitors, according to news reports. The unidentified couple was caught in the act at the fair’s concession seating area and was captured on camera by visitors. The video was posted online and circulated on social media until Wisconsin State Fair officials removed it. "We’re here for a horse show or a dog show — not to make babies," a visitor named Morgan Hakenson at the state fair said.

"When Wisconsin State Fair officials were apprised of this appalling viral video post, a thorough investigation was conducted and the video was removed," fair spokesman Kristi Chuckel said at the time, according to a New York Post report.

In May 2015, a jury found a couple guilty of having sex on Bradenton Beach in Florida on July 20, 2014. The couple was charged with two counts of lewd and indecent behavior for having sex on a public beach, according to a Miami Herald report at that time. The couple's act was caught on video and witnesses had testified that a 3-year-old girl was present at the scene and saw them.
