Joe Giudice, who is married to "Real Housewives of New Jersey" star Teresa Giudice, has managed to avoid deportation back to his native Italy for the time being. Joe was released from prison in March following a 41-month prison sentence.

The Blast reports that the United States Court of Appeals for The Third Circuit ordered Giudice to remain in the United States while battling the deportation case. Sources tell The Blast that his legal team is working hard to get him out of custody and stop the deportation.

His wife, Teresa, previously told Bravo producer Andy Cohen that she is prepared to divorce her husband if he is deported.

The reason Giudice was in prison was due to tax fraud. When he was released in March, he was held in ICE custody. However, his oldest daughter, Gia, has been trying her best to get him home and even appealed to President Donald Trump.

The 18-year-old created a petition on Change.org in April on behalf of her mother and her three sisters and wrote, in part, "We request that our President, Donald J Trump review our petition and pardon my father to relieve him of this life sentence the courts are bestowing on him, yes in Italy he will no longer be incarcerated but will he ever be free if kept from his family and be able to be a productive member of society?"
